Consent - Division 12A of the Family Law Act

This form has been prepared by the Court where consent is required for less adversarial trials (Division 12A) to apply to a case.  Such cases involve:

- where you are asking the Court to make orders about financial matters as well as about the child(ren) consent is required to include the financial matters

- where you are asking the Court to make orders only about financial matters

Cases which involve an application filed after 1 July 2006 asking the Court to make orders about children do not require consent as the less adversarial trial apply automatically.

Before signing and filing this form you are advised to take independent legal advice.

When do you file it
A consent is filed in those cases described above when directed by the Court.

Number of copies of the consent for filing, service and yourself
The completed and signed original of the consent is filed at the Court. Before you file it you must also make sufficient copies to have one for each person to be served and a copy for your own records.

Each party to the case and any independent children’s lawyer
