Applications for interim parenting orders (for example, orders about who the children live, spend time and/or communicate with or other parenting orders) are made using an Application in a Case. A response to an Application in a Case is made using a Response to an Application in a Case form.

When a respondent seeks orders in a Response to an Application in a Case, the Form may be accompanied by this affidavit which sets out facts supporting the respondent’s case.

Number of copies of the affidavit for filing, service and yourself
The completed and signed original of the affidavit filed at the Court. Before you file it you must also make sufficient copies to have one for each person to be served and a copy for your own records.

Each other party and any independent children's lawyer

What is filed in response
If:

the applicant may file an affidavit setting out the facts relied on to oppose those orders.
