The Family Court of Australia has been working with the Federal Circuit Court and Federal Court to enhance the electronic capabilities of the courts. This includes enhancements to the electronic filing of documents, which will provide practitioners and litigants with more ways of interacting with the Court electronically. The Court will also implement a digital court file, expected to commence operation in late 2018.

In preparation for this, the Court has developed a practice direction dealing with the official court record. The new Digital Court File Practice Direction (No 2 of 2017) has been issued and takes effect from 21 September 2017.

This Practice Direction sets out how the official court record is to be constituted as the court transitions into a more electronic environment.

While this Practice Direction does not directly impact on the practice and procedures to be followed, it signals the beginning of changes to court practice towards a more electronic environment.
