PRACTICE DIRECTION: NO. 2 OF 2017
DIGITAL COURT FILE
The Family Court of Australia is moving to implement in each of its registries a digital court file for proceedings in the Court.
This Practice Direction establishes the manner in which case files of the Family Court may be constituted. It applies to all proceedings in the Court.
The official file for any proceedings in the Family Court, subject to any order made by the Court in that proceeding, is:
for all proceedings for which a digital court file has been created by the Court – the digital file for that proceeding;
otherwise – the paper file created by the Court for that proceeding.
The Family Court manages its official records, including the official case file for proceedings, under the Archives Act 1983 (Cth) in accordance with specific and general authorities and normal administrative practice approved by the National Archives of Australia.
